The Town of Fort Erie Cemetery By-law
NOTICE The Corporation of the Town of Fort Erie has submitted By-law No. 25-13 to Regulate and Control the Operations and Care of Municipal Cemeteries to the Registrar of the Funeral, Burial, and Cremation Services Act 2002.
This by-law is available on the Town’s website at www.forterie.on.ca or may be reviewed or copied at the John L. Gibson Operations Centre at 1818 Pettit Road, Fort Erie.

This by-law is subject to the approval of the Registrar, Funeral, Burial and Cremation Services Act 2002. Telephone: Cemeteries Regulation Unit 416-326-8393.
Once approved, By-law No. 25-13 will replace Cemetery By-law 57-93.

Excerpts from By-law No. 57-93 regarding Lot Decorations:
- In recognition of Special Observance Days, decorations as listed below, may be placed on any part of a lot for one(1) week preceding until one(1) week following each such Special Observance Days (Christmas is the exception of this rule and is addressed otherwise in this by-law, namely: potted plants, artificial flowers, tripods, and/or stands, vases/urns (except permanent "Daisy Vases")
- Winter wreaths without glass or plastic covers and artificial flowers are allowed to be placed on any lot after the 1st of December in any year.
- To preserve the proper appearance of the grounds in the Cemetery, artificial flowers and wreaths must be removed before April 1st of each year otherwise, the Cemetery Manager will have them removed.
- Only decorations that have been placed totally within a flowerbed area or securely fastened to and hung from a monument will be allowed to remain after the one(1) week period after the Special Observance Day.
- Rose bushes are not permitted on any cemetery lot.
- Where plantings or other decorations are placed within a planting bed area, the same shall be removed annually not later than October 31st in any year, and the entire area of the flowerbed is to be left in a neat appearance. Failure to do so may cause the Cemetery Manager to have the plantings or other decorations removed by the Corporation staff without recourse against the Corporation by any Interment Rights Holder.
- To preserve the orderly appearance of the Cemeteries, any flowerbed of the previous year which has not been planted by June 15th of any following year, may cause the Cemetery Manager in his/her discretion to have the flowerbed removed by the Corporation staff and to have the same replaced with sod without recourse against the Corporation by an Interment Rights Holder.
- No monument may be erected which is composed in whole or in part of:
(a) Wood
(b) Metal
(c) Marble veneer or other veneer
(d) Block or cement facing or exterior or
(e) Of any material not of permanent nature and durable quality.
- Temporary markers, as normally provided by the Funeral Homes, are permitted for a period of six(6) months from the date of the burial.

The Cemetery Advisory Committee has been established and appointed by Council to provide advice and make recommendations to Council with respect to any matter pertaining to the administration of the cemeteries, including budget, rate changes and any major projects conducted in the cemeteries.
